EKSA (hereinafter "the Data Controller") is a company whose corporate purpose is, among other things, book distribution. The website at www.elkarbanaketa.eus (hereinafter "the website") is the property of EKSA. Any person visiting and using this website is a user of the website (hereinafter "the user").
1. General Conditions
The user accesses this website on a voluntary basis. Access to this website is free. Browsing this website implies agreement to and awareness of the legal warnings, conditions and terms of use and privacy policy and cookie policy contained in it. If the user does not agree to these conditions and does not give their consent, they must not make use of this website.
Access to this website, and whatever use may be made of the information it contains, are the sole responsibility of the user. The user undertakes to make use thereof in accordance with the purpose of the website. The user may not make any illicit use of the information contained on this website, or take any actions that could harm or affect the information systems of this website.
Users must not include or pass on content that is false or inaccurate or that could lead EKSA, other users or third parties to make mistakes. The user bears sole liability for any harm that might be caused by passing on such data. Third-party data must not be used without their consent, likewise data identifying third parties with the aim of passing as or pretending to be any other person or organisation.
EKSA makes every effort to avoid errors in the content published on the website, and reserves the right to change it at any time. EKSA explicitly declines any liability for errors or omissions in the content of this website and for any damage or harm that might arise as a result of the said content being untrue, inaccurate or out of date.
The website may provide links to other websites or offer access to them through a search engine included in the website. EKSA takes no responsibility for the sites linked to, or for the results of searches, as it has no control of any kind over them, their content, products, services offered, etc. The purpose of these services is to inform the user of other sources of information, the content of which the user accesses on their sole responsibility and in accordance with the conditions in use governing them.
In the case of links to social networks owned by the Data Controller or by third parties, these will be governed by the general conditions of the said networks.
EKSA takes no responsibility for any consequence, damage or harm that might arise from the use of this website or its content, including damage to information systems and the introduction of viruses or malicious software of any kind. The Data Controller does not guarantee the absence of viruses or other harmful elements on this website where these are inserted by outside third parties and might have effects on users' hardware or software, though it uses the means at its disposal to avoid this happening.
EKSA reserves the right to change or delete the design, configuration and information contained on this website at any time without prior notice and/or explanation, should it see fit. The Data Controller is not liable for any harm such changes might cause. However, it will use the means at its disposal to inform users of such changes.
2. Registration
Access to this website does not involve any obligation to supply personal data. However, access to the private area requires prior registration. For registration to be secure and the service offered correct, the user must supply a series of personal data.
The user undertakes to supply truthful, accurate and complete data, both when they register and in subsequent communications, and takes responsibility for reporting any change to this data.
Use of this website implies agreement to the EKSA general conditions, privacy policy and cookie policy.
3. Use of access codes
Codes for accessing the private area are personal, confidential and non-transferable. Registered users undertake to use them responsibly and not to pass them on to anybody else. Registered users must not pass on their codes to anybody who asks for them by telephone, email, through this website or in any other way.
EKSA recommends that the user code and password be different and contain at least eight alpha-numeric characters. The user must memorise their codes and must not save them in any kind of medium, whether physical or electronic, to which other people might have access. Access codes must be changed regularly, at least once a year.
It is important that users log out of their personal account at the end of every session, in order to ensure that nobody can gain access to their personal information if they share their computer with somebody or use a computer in a public place.
If the user forgets their password, they must notify EKSA, which will automatically give them a new password. EKSA recommends changing this the first time it is used, so that the user has a password that is easy for them to remember and hard for an unauthorised third party to guess.
The user must notify EKSA immediately of any incident, security breach, undue or unauthorised access to their access codes that they might detect.
4. Intellectual and industrial property
The rights to this website, to its pages, sections, screens, the information they contain, its experience and design, texts, photographs, images, products and services, trademarks, logos, slogans, etc. are the property of EKSA except when specified otherwise.
Under no circumstances does access to or browsing of the website imply any waiver, transfer or licensing by EKSA for the user's personal use of its intellectual and industrial property rights, either wholly or in part. Any unauthorised reproduction, distribution, commercialisation or transformation of these works represents a breach of EKSA's intellectual property rights.
The user undertakes not to take any action that might harm the owner of this website. Any unauthorised use of the information contained on this website, as well as harm caused to its owners' intellectual and industrial property rights, may lead to the pertinent legal steps being taken, with the liability arising from this.
5. Changes
These conditions are subject to change when EKSA sees fit, either to adapt them to legislative changes or to make improvements of other kinds. Such changes will take effect from the time of their publication on this website. EKSA will use the means at its disposal to inform website users of the changes made.
6. Jurisdiction
Relations between EKSA and the user will be governed by the stipulations of current regulations in terms of applicable legislation and competent jurisdiction. However, in cases where regulations provide for the possibility of users submitting to a forum, EKSA and the user explicitly waive any other jurisdiction that might pertain to them for whatever reason and submit to the Courts and Tribunals of the city of Donostia-San Sebastián (Gipuzkoa).
EKSA will prosecute any infringement of the above conditions, as well as any improper use of the content presented on its website by bringing all the civil and criminal actions that might be open to it by law.
